New law enables SPO to prosecute the president, MPs, ambassadors, judges…

The Ministry of Justice has announced a draft law on the Special Prosecutor’s Office which changes the competencies for crimes that may be the subject of this institution in relation to the current legal solution. So far, the Special Prosecutor has been authorized and is competent to investigate and prosecute crimes related to the content of the unauthorized interception of communications carried out between 2008 and 2015.

The proposed solution envisages that the SPO will be able to investigate and prosecute crimes committed by the President of Macedonia, appointed ambassadors and other representatives abroad and appointed persons by the president, elected or appointed officials in and out of Parliament, the Government, the courts, the Public Prosecutor’s Office, the Judicial Council, the Council of Public Prosecutors and elected mayors within the local self-government and the City of Skopje.

It is envisages that the competence for the SPO to prosecute for crimes committed by responsible persons in political parties in elections and voting, as well as in the area of ​​environment and nature, cultural heritage and natural rarities, public finances, payment operations and the economy, the armed forces , official duty, unauthorized disclosure of information and data for witnesses, and others, if the acts were committed in connection with proceedings conducted by the Special Prosecutor’s Office.
