Constitutional Court didn’t open a procedure for insult and defamation

At today’s session, Constitutional Court didn’t open a procedure to assess the constitutionality of the whole of the Law on Civil Liability for insult and defamation.

The initiative was filed by 12 applicants.

The decision of Constitutional Court was made by majority vote.

In the motion, petitioners demanded the Constitutional Court to declare the entire law unconstitutional, and if they do not do so, to open a procedure for Article 7, paragraph 1, point 1 and 2 in the section “of investigations of criminal offenses or misdemeanors”, for Article 4, paragraph 2, for Article 6, paragraphs 1,2 and 3, for Article 8, paragraph 3, for Article 9 and for Article 18, paragraphs 1 and 2, and to reject the motion for Articles 3 and 25, paragraph 3.

According to the petitioners, these articles, as well as the entire law, are contrary to the Constitution and the European Convention on Human Rights.

This Law regulates civil liability for insult and defamation.

According to the Court, the law was adopted with an intention this matter for insult and defamation, which came out of the Criminal Code, to be subject to civil proceedings, where the regulation is already based on European law.
