The court defends its ruling over the oppositions ‘bombs’

After the dilemma, which unfolded in the media and discussed by the experts over whether the judge of the previous procedure was permitted to intervene and declare the oppositions “bombs” invalid as evidence while the case is still in its early stages. The Basic Court Skopje 1 say that the judge’s decision is legal at this stage of the investigation.
According to the Code of Criminal Procedure (CCP), the court said a judge from a previous procedure may decide at any stage of court proceedings submission.
According to the court, the previous procedure begins with a preliminary hearing, the judge from the previous procedure at this stage is the one who decides for the rights of the accused.
Only the court can intervene by request to separate the evidence submitted to the judge from preliminary proceedings filed by counsel to defendants involved in a criminal case and who are parties to the proceedings before the public prosecutor.
