Strasbourg found that the investigation into the case of Martin Neshkovski was legally conducted

The European Court for Human Rights ruled that in the case of the murder of Martin Neshkovski, there has been no violation of Article 2 of the European Convention on Human Rights in terms of the effectiveness of the investigation into Martin Nehskovski’s death, reported the “Akademik“.

Martin Neshkoski’s mother Lenka Neshkoska, objected to the European Court of Human Rights that the investigation into her son’s death was not effective.

The Court explained that her son, Martin Neshkoski, was killed by a member of the special police forces during the celebrations of the results of the 2011 elections.

Referring to the domestic hearing against the officer in question Igor Spasov, the court emphasized that for the murder of Martin Neshkovski, there was a trial, which resulted in a 14-year sentence for Mr Spasov.

In connection with the investigation of the case, the court argues that the Public Prosecutor in the case requested the investigating judge to open an investigation against Spasov, but during the investigation, Martin Neshkoski’s mother filed criminal charges against four other people, three of whom were also police officers, under the suspicion that they had helped Spasov attempt to conceal the murder, and gave false statements to the Public Prosecutor that Neshkoski had died from a drug overdose.

However on November 29, 2011, the Prosecutor dismissed the criminal charges, finding no grounds that the three mentioned people could be criminally prosecuted. Overall, looking at the evidence, he found that the three individuals were not present when Igor Spasov’s deadly punch hit Neshkoski. Dissatisfied with this decision, Martin Neskovski’s mother continued to seek justice from a subsidiary Prosecutor. In this case her application was also rejected.
