The State Public Prosecutor, Ljubomir Joveski announced that Public Prosecution’s expert collegium during its meeting today has decided that the legal opinion of the Supreme Court regarding the SPecial Prosecution’s Office’s cases is violating the legality and it will lodge a request at the Parliament in order to obtain an authentic reading of Article 22 of the Law on SPO.
Two days ago, the Criminal Court in Skopje requested from the State Public Prosecutor Ljubomir Joveski to provide his opinion which prosecution will be acting in the future as an authorized prosecutor in the cases that were filed by the Special Public Prosecution.
The Court has stressed that until the State Public Prosecutor provides his opinion whether the cases will remain under the custody of SPO or will they be taken over by the Public Prosecution for Organized Crime and Corruption, Basic Court 1 – Skopje will be acting in accordance with the enactments of Law on Criminal Law, and regarding SPO’s cases that were received after the deadline, for which the Supreme Court provided its opinion, and which are urgent and cannot be delayed, it will be decided upon by authorized criminal councils, with the goal of avoiding unnecessary protracting.
