For which issues, according to the Constitution, a two-thirds majority in the Parliament will be necessary

The current allocation of sides at the Assembly of Republic of Macedonia, after the early parliamentary elections, won’t allow any party or coalition regardless how it will be assembled (unless a government is made by all parties), will not allow a two-thirds majority in the Parliament.

The two-thirds majority i.e. 81 of total number of MPs is necessary for making some of the decisions and the laws at the Parliament like, for e.g. any intervention in the Law for the Special Prosecutor’s Office. A majority of 81 MPs is also necessary for an implementation of the reforms, as were evidenced in the report by the German expert Reinhard Priebe.

In case VMRO-DPMNE enters into a coalition with all Albanian parties that have won MP seats in the Parliament, the total number of votes that it can count on would be 71 and if SDSM enters into a coalition with all Albanian parties in the Parliament, it would have a majority of 69 MPs.

According to the Law for the Special Prosecutor’s Office, i.e. Article 3, clause 1,
“ this law will come into force for five years starting from the moment it was voted at the Assembly and can be prolonged once a year by a decision brought by a two-third majority of MPs.

Article 3 of the Law for SPO states that “The Parliament will determine the candidate for a (special) public prosecutor by a tho-third majority including a majority of votes by MPs which belong to communities that are not a majority and will be submitted to the Council of Public Prosecutors.”

According to article 17, the motion for ending the function of a public prosecutor that is managing with SPO is determined by the Parliament of Republic of Macedonia that in accordance with a previous approval by the four political parties with the largest number of MPs at the Parliament with a two-thirds majority of votes by MPs that belong to communities that are not a majority.
