Constitutional Court Schedules its First Session: SPO Not on the Agenda, But Cross in Butel is

Today, the Constitutional Court announced its agenda for their first session after the two-month summer recess, which is scheduled for September 28, at 9:00am. At the session, as an item on the agenda, the constitutionality of the Law on the Special Prosecutor’s Office is not listed, while the initiative for constructing a cross in Butel is.

The initiative for assessing the constitutionality of the SPO was submitted to the court ten months ago, however, it has yet to be put on the agenda of the sessions of the Constitutional Court. This initiative was a key requirement made by the “Colourful Revolution” and the opposition.

This issue was also brought up in the agreement from July 20 between the political parties, signatories to the Pržino Agreement. The agreement clearly stated the need to support the Special Prosecutor, and the Constitutional Court is to rule on its constitutionality, the four parties need to agree on the legislation with the decision of the court within five days.

The four parties, the Agreement added, will call on the Constitutional Court as soon as possible to decide on the law for the SPO, that is, at the next scheduled session.

“In case the Constitutional Court rules that the law on the SPO or part of it is unconstitutional, the four political parties have vowed to agree on the law with the decision of the Constitutional Court and form the Prosecution again, and decide within five days. The performance, goals, and scope of the Special Prosecutor’s Office must be kept”, states the agreement of July 20.

The initiative for assessing the constitutionality and legality of the decision to build the cross, can be seen in the agenda on the website of the Constitutional Court’s 11 point agenda.

The initiative for assessing the constitutionality of the decision to construct the 55-metre cross in the Butel Municipality in March, was submitted by the Mayor of Struga Zijadin Sela, on the grounds that building the cross it is not in accordance with the Badinter principle.

Although the initiative is on the agenda of the court, the discussion on the intiative was postponed three times.

The building of the cross, which was donated by the World Macedonian Congress (WMC), towards the end of February and early March caused tensions after members of the DUI party and their supporters set up camp and protested against the construction of the cross, which was met with counter-responses from the WMC. The President of the World Macedonian Congress, Todor Petrov was physically attacked the day after the ceremony when the cornerstone was consecrated.
