Kežarovski: I was rotting in a prison cell because of a false witness planted by the secret police

After a decade of trials and several repeated court procedures regarding the case of “Oreshe”, the court in Veles gave a freeing verdict for the accused in this case.

Journalist Tomislav Kežarovski, who spent a year and nine months in detention because of the “Oreshe” case, has issued a statement on his Facebook profile.

“The explanation of the verdict states that the protected witness was neither protected nor endangered, but was a false witness who was testifying after being instructed by the secret police just like I wrote about in the weekly magazine “Reporter 92” and for which I was a suspect, the accused and imprisoned. Why was I rotting in prison cells? Why did I lose my health for?
And now prosecutor Lile Stefanova, what shall we do? And now judges Ranja Mihajlova, Gjoko Ristov and Dijana Gruevska – Ilievska what shall we do now? What will you say in your defense,? wrote Kežarovski.


Journalist Kezharovski tells Zaev to visit the cells at the “Shutka” jail as soon as possible

The journalist, Tomislav Kezharovski, after spending half his sentence in the county jail “Shutka” in the Skopje neighborhood of Shuto Orizari, today suggested that Prime Minister Zoran Zaev visit the cells at the county jail in Shutka.

The reason for Kezharovski’s facebook status was the visit of the Prime Minister to the Idrizovo Prison, where he said he was “ashamed of the conditions”.

“I congratulate your efforts to improve the conditions in the Idrizovo prison and even more on your announcement of an amnesty law. But I suggest, as soon as possible, you go and see the cells in the Shutka county. And right there, first in the C-14, and then in the C-19, I spent months locked up with three others. I had no privilege to be in the spacious cells, in the new part. Everyone in C ,were all there who should have been broken”, says Kezharovski in his Facebook status.

He adds that after his verdict was handed down, he asked to be transferred to “Idrizovo” because it was better there.

Kezharovski was sentenced to four years and six months for the “Liquidation”case, where he was charged for uncovering the identity of a protected witness in the “Oreshe” case in his articles by Reporter 92.


Journalist Kezarovski called for a police interview due to his involvement of the colouring of Parliament

Journalist, Tomislav Kezarovski was today called to the Central police station for a police interview.

Kezarovski said on his “Facebook” profile that he believes he has been called for questioning regarding throwing paint at Parliament on May the 28th.

“The Central Police Station sent a telegram to me for a police interview, (or what they call here an ‘informative chat’). I will go to today to the police station at 18:30. I have been called because of my involvement of the colouring of Parliament. With this, my biography will now be complete”, wrote Kezarovski.


Memorial occasion marks the anniversary of the protest for Kezarovski

Dozens of journalists and citizens gathered today in front of the Museum of Revolutionary Struggle, to mark the anniversary of the protest when journalist Tomislav Kezarovski was arrested. The Kezarovski family also attended the the gathering for the anniversary.

The initiative to mark this day was Tomislav Kezarovski himself. On his profile on the social network “Facebook”, he wrote that he wanted to thank his colleagues who supported him while he was in custody.

“I came here today, for me this is a sacred place to express my sincere thanks to all my colleagues and all supporters of the freedom of speech, which on this day two years ago, we raised our voices against the decision of the court of the four-and-half-year sentence just for a for a written text. Then I was not able to be with you. I was in prison. I was not even able to attend last year when we marked one year of the event, as I was under house arrest. So now, on this day, I am here where police raised their hands at journalists, where police raised their hand at the open minded man, where someone wanted to silence the people”, said Tomislav Kezarovski.

 


Kezharovski remains free, Court of Appeal dismissed prosecution’s appeal

Dismissing the appeal by the Public Prosecutor’s Office for Organized Crime, Court of Appeal today confirmed the decision of Basic Court Skopje 1 for parole of journalist Tomislav Kezharovski, which means that he will not return to investigative prison “Skopje”, where he was supposed to endure the remaining three months of the verdict, reports “Fokus”.

“A decision confirming the first instance decision for parole and rejecting the appeal of the prosecution was reached,” said judge Safet Kadriu from the Court of Appeal for “Fokus”.

Early last month, Court of Appeal reduced the first-instance verdict of Kezharovski for the case “Liquidation” and sentenced the journalist to two years in prison. This caused outrage among journalists and the news organizations that got momentum after Kezharovski’s express transference to the prison “Skopje” to serve his sentence.

Kezharovski is currently free after, on the request of the director of the prison, last month he received a cease of serving the sentence within 30 days due to health reasons.

Journalists’ associations repeatedly sent a message that the only fair sentence for Kezharovski is acquittal because the journalist is not guilty.


Court of Appeal should decide whether Kezharovski remains free in two days

Court of Appeal in Skopje should state whether the journalist Tomislav Kezharovski should stay on parole or have to return to prison to serve the remaining three months in jail by Tuesday at the latest, reports “Fokus“.

Court of Appeal reduced Kezharovski’s sentence from four and a half to two years after his detention was included. After reduction of the sentence, Kezharovski has to serve only three months from his sentence.

Kezharovski applied for parole because 90 percent of the sentence is served. Trial court accepted his request, but the Public Prosecution appealed to a higher court, so the decision of the first instance cannot become effective until the ruling of the higher court.


Journalists’ associations are shocked by the decision of the prosecution for Kezharovski

The journalists’ associations reacted to the decision of the prosecution to appeal the decision of Basic Court Skopje 1 for the parole of journalist Tomislav Kezharovski.

President of the Union of Journalists Tamara Chausidis said that she is surprised and shocked by this decision.

– They waited for the very last day and on Friday they reacted in an attempt to reduce or minimize the reactions. It is illusory from them to think that we won’t demand Kezharovski’s release. He is innocent and we will fight to the end to prove it. This is further harassment for him and his family. It shows what they are doing not only journalists, but to the people in Macedonia – says Chausidis.

Macedonian Association of Journalists (MAJ) also protested to the decision by the prosecution to appeal the decision to parole journalist Kezharovski.

“Macedonian Association of Journalists (MAJ) is surprised how much energy the competent prosecution is wasting to put a journalist behind bars, while courts complain about pressure from journalists for sentencing a journalist for a written text. On the other hand, the judicial system expects free journalists and investigative journalism. With this treatment, as the case with or colleague Tomislav Kezharovski for a written text, it is not possible,” reads the statement.

Pubic Prosecution for organized crime and corruption appealed the decision to parole Tomislav Kezharovski.

“Within the statutory deadline, the competent public prosecutor reviewed the decision for parole of the Basic Court Skopje 1. Considering that the decision incorrectly determined the situation in the case and that the convicted person is not eligible for parole, the public prosecutor filed an appeal for the decision”, reads the statement.

Lawyer Filip Medarski says that now they can only await the decision of the higher court (Court of Appeal) and expect a positive resolution.

– We are working on the request to the Supreme Court for extraordinary review of the first instance decision and expect it to be delivered over the next week – said Medarski.

There is not a deadline in which the Court of Appeal should answer to the appeal of the public prosecutor.

“Within the statutory deadline, the competent public prosecutor reviewed the decision for parole of the Basic Court Skopje 1. Considering that the decision incorrectly determined the situation in the case and that the convicted person is not eligible for parole, the public prosecutor filed an appeal for the decision”, reads the statement.

Lawyer Filip Medarski says that now they can only await the decision of the higher court (Court of Appeal) and expect a positive resolution.

– We are working on the request to the Supreme Court for extraordinary review of the first instance decision and expect it to be delivered over the next week – said Medarski.

There is not a deadline in which the Court of Appeal should answer to the appeal of the public prosecutor.


Kezharovski is released, but they keep him on a short probation leash

Journalist Tomislav Kezharovski is released. As he was suddenly imprisoned after the passing of the verdict by the Court of Appeal for two years in prison, the journalist was suddenly released with a decision for a one-month of leave in the same manner.

Today the court announced that it accepted the request for parole for Kezharovski.

The sequence of events and circumstances raise the question of whether, after all the vicissitudes and court controversy, Kezharovski won the battle or the state is trying to get out of the situation with the recent decisions of the judicial authorities, by making optimal compromise in the case of Kezharovski.

The question cannot be seen in one dimension. Kezharovski is currently not in jail and is with his family, which can be seen as a good occasion in case. However, journalists and journalists’ organizations, which protested in front of the Court of Appeal and the Government three days, feel the parole of Kezharovski doesn’t capture the essence of the procedure led against the journalist, but just an alibi, an attempt by the Government to get out of the pressure after the imprisonment decision and the actual imprisonment of the journalist.

– After all the pressure by journalists, journalists’ organizations, the democratic capacity in the country, citizens, colleagues from Europe and the world, international institutions, by all that stood behind the innocence of journalist, the Government released Kezharovski from prison. It is an attempt of the Government to get out of the situation and cover its sins. The release and now, the acceptance of the application for parole, is good for Kezharovski and his family. But that is only one side and it is not enough – says journalist Zoran Dimitrovski from Board for initiative for the release of Kezharovski.

They based their position on a single fact that the court does not want to admit, which is that Kezharovski is innocent of the crime he was convicted. That fact cannot be erased by the parole (which, among other things, is still uncertain because the prosecution may appeal on the decision).

President of AJM Naser Selmani stated for META that “it is premature to draw conclusions.”

Today, thorough an announcement, the Macedonian Association of Media (MAN) expressed its view that the association “welcomes the decision journalist Tomislav Kezharovski to be released on probation, i.e. to be released from serving the sentence.”


Chausidis to Poposki: Ignorance and conscious stupidity are most dangerous

Foreign Minister Nikola Poposki today stated that it was unclear why reporters protested yesterday for the release of journalist Tomislav Kezharovski when he had already been released from prison “Skopje”.

– Most of us do not understand what the protest was about because we know that all were informed that the person concerned is released. I think it would be wrong to bring conclusions for the overall picture based on a single case – said Poposki at a joint press conference with Foreign Minister of Austria Sebastian Kurz in Skopje, the media reported.

He added that “reforms in the media will continue and that all participants in the process have their own responsibilities.”

– So, they thought that the provisional release of journalist convicted for a text will change something? I really do not know how to comment that “awe” and “ignorance” of the minister and the others who don’t understand why thousands protested yesterday, except to repeat the words of Martin Luther King: “Nothing in all the world is more dangerous than sincere ignorance and conscientious stupidity.”- says Tamara Chausidis from the Independent union of journalists in the response to Poposki’s statement for META.

President of the Association of Journalists of Macedonia (AJM) Naser Selmani stated for META that the battle didn’t end with yesterday’s protest in front of the Government and announced further activities.

– We will make sure to keep the tension to the end, but we won’t reveal our further activities – said Selmani.

Journalist Kezharovski yesterday was suddenly temporary released from prison “Skopje”, to which he was transferred from house arrest on Friday night, a day after the verdict of the Court of Appeal, with which he was sentenced to two years of prison in the case “Liquidation”, was announced.

Kezharovski was released just a few hours before the protest of journalists and journalists’ organizations in front of the Court of Appeal, which was afterwards taken in front of the Government with a march.

At the protest, representatives of journalists’ associations and journalists directed fierce message to the Government and openly expressed their doubts about the real reasons for the arrest, detention and conviction of journalist Kezharovski.

Apart from the decision to temporarily release the journalist from prison due to health reasons, the warden of prison “Skopje” sent a request to the Basic Court Skopje 1 for a parole for Kezharovski, on which the court should bring a decision in the next days.
