Strasbourg rules in favour of journalists who were removed on “Black Monday”

The European Court of Human Rights and Fundamental Freedoms decided in favor of journalists Naser Selmani, Natasa Stojanovska, Frosina Fakova, Snezana Lupevska, Biljana Bogdanovska and Toni Angelovski, who were physically removed from a parliamentary session during the adoption of the budget on the 24th of December, 2012.

The Journalists demanded damages of 5,000 euros each, while the Government contested these claims calling them unsubstantiated and excessive. The court decided each applicant to be paid 5,000 euros on the basis of non-pecuniary damage.

The Strasbourg court ruled that in this case, there had been a violation of Article 10 of the European Convention on Human Rights, concerning freedom of expression, and Article 6, which concerns the right to a fair hearing.

In Article 6 of the Convention which was invoked by the journalists applicants to Strasbourg, it says that everyone is entitled to a fair and public hearing within a reasonable time and impartial tribunal established by law.

Article 10 of the Convention states that everyone has the right to freedom of expression. Under the Convention, this right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. This Article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises.
