Government of RM: Ivanov has misused his position in order to block the democracy

The Government stated that it supports the decision where the Law on languages and the Law for the ratification of the Prespa Agreement to be published in the Official Gazette with the signature of the President of the Parliament, Talat Xhaferri, while at the same time it has taken into account “the violation of the Constitution on part of the President Gjorge Ivanov.”

“The passing of the Law on use of languages and the Law for ratification is under complete custody of the Parliament of the Republic of Macedonia. Ivanov was obliged to sign the decree for both laws to pass, and when he decides to misuse the Constitution it is necessary to take steps that are in accordance with the Constitution in order for the parliamentary democracy to continue to function” stated the government.

The announcement stated that according to Article 51, Paragraph 2 of the Constitution, everyone is obliged to obey the Constitution and the laws including the president of the state.

“The president of the state is obliged to sign the decree for proclaiming the laws that are passed by the Parliament if they are passed for the second time with the necessary majority at the Parliament. Both laws, the Law on use of languages and the Law on ratification the Prespa Agreement were passed for the second time with the necessary majority at the Parliament of the Republic of Macedonia. The Law on the use of languages was passed in March last year and the Law on the ratification was passed on the 5th of July, also last year. According to constitutional enactments, and because of the president’s avoiding to fulfill his duties that result from Article 52 from the Constitution according to which the laws that were passed for the second time with the necessary majority at the Parliament should be published in the Republic of Macedonia’s Official Gazette, 7 days after they were passed” states the press release.

The problem was caused by Ivanov who has misused his rank and has threatened to block the functioning of the democracy, accuses the government.

The government thinks that with this procedure the president of the Parliament has stopped the tendency where one ceremonial procedure by the president of the state to be turned into a precedent that threatened to block the functioning of the system and the violation of the Constitution” states the government’s press release that also stated that the president of the state is not a legislative body.
